Terms governing the KiffOS Pro subscription taken out on kiffos.fr.

This English text is a courtesy translation. The French version is the legally binding reference.

1. Purpose and publisher

These Terms of Sale govern subscriptions to KiffOS Pro, published and sold by Stéphane Mejias, sole trader (entrepreneur individuel) operating under the trade name “Kroneo Studio”, SIRET 402 015 994 00062, registered office at 20 rue Amédée VII, 06300 Nice, France (“the Publisher”). Any order implies unconditional acceptance of these Terms.

The KiffOS Enterprise offering, intended for businesses and quoted individually, is not covered by these Terms: it is governed by a separate agreement entered into between the Publisher and the client company.

2. Product

KiffOS is a native application for macOS (Apple Silicon Mac, macOS 11 or later), run locally on the user's device. The KiffOS Free edition is free, permanent, and requires neither an account nor a subscription; the KiffOS Pro edition unlocks additional features for the duration of the subscription, via a license key.

3. Editions, subscription and price

  • KiffOS Free is free of charge and remains so with no time limit. It requires no account, no subscription and no Internet connection.
  • KiffOS Pro is a subscription, at the price shown on kiffos.fr at the time of order (€6.90 per month or €69 per year as of these Terms).
  • Prices are stated in euros, all taxes included. VAT not applicable, art. 293 B of the French Tax Code (VAT exemption).
  • All software updates, including major versions, are included at no extra cost for the entire duration of the subscription.
  • Any price change is notified to the subscriber at least thirty (30) days before it takes effect. A subscriber who does not accept it may terminate before that date, free of charge.

4. Term, renewal and termination

  • The subscription is entered into for the period selected at the time of order (monthly or yearly) and renews automatically at each renewal date, until terminated.
  • The subscriber may terminate at any time, free of charge and without having to give reasons, directly online from the customer portal (sign-in by email and one-time code, no account required), in accordance with Article L215-1-1 of the French Consumer Code. The same portal is reachable from the app (Settings → License → “Manage my subscription”). A request sent to contact@kiffos.fr has the same effect.
  • Termination takes effect at the end of the current period, which has already been paid for: the subscriber keeps access to KiffOS Pro until that date. Periods already started are not refunded on a pro rata basis, without prejudice to the subscriber's statutory rights.
  • When the subscription ends, the application automatically reverts to the KiffOS Free edition and remains fully usable: no user data is deleted and the local artificial intelligence keeps working. Only the features specific to the Pro edition are disabled.
  • The Publisher may terminate the subscription in the event of persistent non-payment or serious breach of the Terms of Use, after a formal notice has remained without effect.

5. Payment

Payment is made online by card via the secure payment provider Stripe, which charges the card at each renewal date until termination. The Publisher has no access to any card data.

6. Delivery

After payment, a license key is sent automatically to the email address provided at the time of order, generally within a few minutes. The key is activated in the app (Settings → License). The software is downloaded freely and for free on kiffos.fr.

7. Right of withdrawal

The subscription covers digital content supplied immediately. By activating their key, the consumer customer requests immediate performance of the supply and expressly waives their 14-day right of withdrawal (art. L221-28, 13° of the French Consumer Code). This waiver does not affect the right to terminate the subscription at any time, as set out in article 4. Between professionals, the right of withdrawal does not apply.

8. Warranties and satisfaction

The customer benefits from the statutory guarantees of conformity and against hidden defects. The KiffOS Free edition lets you try the product for free, with no time limit and no commitment, before taking out any subscription. For any issue, contact contact@kiffos.fr.

9. Intellectual property

The Publisher remains the sole owner of the KiffOS software (code, technology, brand). The customer is granted a personal, non-exclusive and non-transferable right of use, defined by the Terms of Use.

10. Personal data

Data processing is described in the Privacy Policy. KiffOS runs locally and does not transmit the user's data to the Publisher.

11. Governing law

These Terms are governed by French law. Failing an amicable resolution, the French courts have jurisdiction; for disputes between professionals, jurisdiction is granted to the Commercial Court of Nice.
